Notice is hereby given in accordance with G.S. 150B-21.1(a3) that the Department of Insurance intends to adopt the rules cited as 11 NCAC 14 .0507 and .0508.

Public Hearing will be held on October 13, 2026 at 10:00am at the NC Department of Insurance, 3200 Beechleaf Ct., Hearing Room 211, Raleigh, NC 27604.

Reason for Proposed Temporary Action: Session Law 2026-48, Part III, Section 66, recently amended G.S. 58-16-5, revising the conditions under which a foreign or alien insurance company may become licensed to do business in North Carolina. G.S. 58-16-5(2)(a) now mandates that foreign insurers must satisfy the Commissioner that it has been successful in the conduct of business. Section 66(c) further directs the Department to adopt rules for implementation of the section, no later than January 1, 2027. Temporary rule adoption is necessary to timely establish consistent standards by which prospective applicants may demonstrate "successful conduct of business" for licensing purposes. Such action is also necessary to provide the Department with a uniform framework for evaluating foreign insurers’ operating history and financial condition as a measure of consumer protection, before granting a license to transact insurance business in this state.

The public comment period is available from September 21, 2026 to October 16, 2026. During this time, the agency will accept written comments on the proposed temporary rule prior to adoption. Written comments from the public will be accepted by mail or email at the following:

Gen. Stat. §150B-21.9(a).

Notice for Permanent Rules

Notice is hereby given in accordance with G.S. 150B-21.2 that the Department of Insurance proposes amendment to the rules cited as 11 NCAC 10 .0313, .0602-.0603, .0605, .1102, .1104-.1109, .1113, .1201-.1202, .1207, .1303, .1403, .1601-.1604; and proposes to readopt without substantive changes the rules cited as 11 NCAC 10 .0104-.0105, .0305-.0307, .0406, .0701, .0703, .0713, .0717, .1001-.1007, .1101, .1110-.1112, .1114, .1204-.1206, .1208-.1209, .1301-.1302, .1401-.1402 and .1701-.1702. The listed permanent rulemaking action is proposed to update and readopt all rules located in Title 11, Chapter 10 of the North Carolina Administrative Code as part of the required periodic review process pursuant to G.S. 150B-21.3A.
