Disclosure Statement Handbook

The Disclosure Statement Handbook provides regulatory guidance from the North Carolina Department of Insurance on the preparation, formatting, filing, delivery, and revision of Disclosure Statements required under Article 64A of Chapter 58 of the North Carolina General Statutes.
Disclosure Statements are formal regulatory filings submitted by licensed continuing care providers and posted by the Department for public access. The Handbook is intended to ensure that these filings are complete, consistent, accessible, and presented in a standardized format that supports transparency, informed decision-making, and effective regulatory oversight.

What the Handbook Covers

The Disclosure Statement Handbook explains:

  • Statutory disclosure requirements under Article 64A, Part 5
  • Standardized section structure and required headings for Disclosure Statements
  • Formatting and accessibility standards for documents posted on the Department’s website
  • Electronic submission, file naming, and versioning requirements
  • Delivery and revision obligations, including annual and interim updates
  • Required appendices, including financial statements, contracts, and other supporting documents

The Handbook applies to all Disclosure Statements filed on or after April 24, 2026, and reflects applicable federal and State digital accessibility standards for documents posted by State agencies.

Illustrative Example Disclosure Statement

The Department has issued a separate Illustrative Example Disclosure Statement as a companion document to the Handbook.
The example demonstrates one acceptable way to organize, format, and present required disclosures in a manner consistent with Article 64A and the Handbook’s accessibility and formatting standards. It is provided for illustrative purposes only and does not replace statutory or regulatory requirements.
Providers must use the standardized section titles, organizational structure, and appendices prescribed in the Handbook. While narrative content may be tailored to reflect a provider’s specific operations, the overall layout, section sequence, and required appendices must remain consistent.

Who Should Use These Materials

These resources are intended primarily for continuing care providers and their advisors, including legal, financial, actuarial, and accounting professionals. They are also used by residents, prospective residents, and other stakeholders who rely on Disclosure Statements as public, consumer-protection documents.
